This website is operated by Sparkwood Collectables. Throughout the site, the terms “we”, “us” and “our” refer to Sparkwood Collectables. Sparkwood Collectables offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy .
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. 
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.
We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.


SECTION 6 - PRODUCT CONDITION DISCLAIMER

Each card sold on our website includes a condition rating based on our visual assessment. These ratings are provided in good faith to assist buyers, but grading is subjective and may differ from individual expectations.

By purchasing from Sparkwood Collectables, you acknowledge that we do not accept liability for any variance in condition opinions. If you're unhappy with an item's condition, returns can be made in accordance with our standard Refund Policy.


SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Sparkwood Collectables, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. You agree to indemnify, defend and hold harmless Sparkwood Collectables and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 18 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

21.1: SPARK5 for 5% Off

Welcome to Sparkwood Collectables! We're excited to help you start (or grow) your collection - and to celebrate, we're offering 5% off. Here’s how it works:

21.1.1: One-Time Per Trainer
This discount is for first-time customers only and can be used just once per account. Whether you're chasing your first Charizard or filling a set, it’s a one-time deal per collector.

21.1.2: SPARK5 Applied at Checkout
You will be required to add the SPARK5 discount in the checkout page. The discount will be applied automatically once added to your basket - no Poké Flute required.

21.1.3: Maximum Discount Value
SPARK5 gives you 5% off your order, up to £35 in total savings. Orders over £700 still qualify - but the discount won’t go beyond that £35 cap.

21.1.4: One Time Use
Each discount is tied to a single customer account and can’t be transferred or reused. If we suspect multiple uses from the same person (even under different accounts), we reserve the right to cancel your order at any time.

21.3 Sparkwood Collectables Giveaway Terms and Conditions

21.3.1 Promotion period

The promotion runs from 17 October 2025 (00:00, UK time) to 30 November 2025 (23:59, UK time) (“Promotion Period”). Entries received outside these times are invalid.

21.3.2 Eligibility

Open to residents of Great Britain (England, Scotland, Wales) aged 18+ only. Employees, contractors or agents of the Promoter and their household members are not eligible. If marketing to Northern Ireland or outside GB, separate terms will be required.

21.3.3 How to enter and tiers

Entry into the paid tiers is incidental to purchase at the usual selling price. No part of the price of any product has been increased to fund this promotion. Entry is automatic and free with qualifying purchases made during the Promotion Period.

  • Tier 1 (Paid): A single qualifying order of £25–£54.99 (after discounts, before shipping) gives 1 entry into Tier 1.

  • Tier 2 (Paid): A single qualifying order of £55–£74.99 gives 1 entry into Tier 2 and 1 entry into Tier 1.

  • Tier 3 (Paid): A single qualifying order of £75+ gives 1 entry into Tier 3, 1 entry into Tier 2 and 1 entry into Tier 1.

21.3.4 Non-stacking rule; discounts; pre-orders; unlimited purchase entries

  • Non-stacking per order: Each order is assessed on its own. Order values do not combine across multiple orders to reach a higher band.

  • Discount codes: Allowed. Thresholds are calculated after discounts and before shipping.

  • All products: All products available on site during the Promotion Period qualify unless excluded in Clause 21.3.9.

  • Pre-orders: Count only when dispatched/fulfilled.

  • Unlimited purchase entries: There is no cap on the number of qualifying orders you can make during the Promotion Period; each qualifying order generates entries as set out above.

21.3.5 Clear examples — spend to entries

  • Example A: Order of £30 → Tier 1: +1 entry.

  • Example B: Order of £30, then a separate order of £30 → Tier 1: +1 (first order) +1 (second order). Total so far: Tier 1 = 2 entries.

  • Example C: Order of £30, then a separate order of £80 → First order gives Tier 1: +1. Second order gives Tier 3: +1, Tier 2: +1, Tier 1: +1. Totals now: Tier 3 = 1, Tier 2 = 1, Tier 1 = 2. (Order values do not stack across orders.)

21.3.6 Returns, cancellations and eligibility checks

Only completed, fulfilled, and non-refunded orders are eligible at the time of the draw. Orders returned or cancelled before the draw will void their related entries. If an order forming part of a winning entry is returned or cancelled after the draw, the Promoter may withdraw the prize and select an alternate winner or require return of the prize if already dispatched. This does not affect your statutory consumer rights. The Promoter may verify identity, eligibility and order status, and may request proof of age and purchase.

21.3.7 Abuse policy

Entries linked to cancelled or refunded orders will be void. The Promoter reserves the right to charge a reasonable admin fee or disqualify entrants where multiple returns are made with intent to exploit the promotion.

21.3.9 Exclusions

Unless expressly stated otherwise, the following do not qualify for entries: gift cards, subscription fees, delivery charges, purely digital items once download/access begins, bulk or resale purchasing, and fraudulent or abusive orders.

21.3.10 Winner selection and dates (pre-Christmas dispatch)

  • Draw date: Friday 12 December 2025 (12:00, UK time).

  • Method: Separate random draws will be conducted for each individual prize listed in Clause 21.3.8 from the eligible entries for that Tier, using a verifiably random computer process or under the supervision of an independent person.

  • Multiple wins: A person may not win more than one prize within the same Tier; however, an individual may win across different Tiers.

  • Notification and claim: Winners will be contacted on the draw date and must claim within 48 hours. If unclaimed or ineligible, an alternate winner may be selected (redraw on/after 15 December 2025).

  • Dispatch: Prizes are normally dispatched within 5 days of winner confirmation (target 15–17 December 2025) via tracked courier for pre-Christmas delivery.

21.3.11 Publicity

Winners’ surname and county may be made available on request for 90 days after the draw. You may object to or request limitation of this publicity for privacy reasons when you claim your prize.

21.3.12 No additional costs to enter, learn the outcome or receive the prize

There is no charge to enter, to learn the outcome or to receive the prize beyond ordinary costs such as standard delivery fees for qualifying purchases.

21.3.13 Data protection

Personal data will be processed to administer the promotion, verify eligibility, contact winners and meet legal obligations, in accordance with our Privacy Policy (https://sparkwood-collectables.com/policies/privacy-policy) and UK data protection law. We will not add you to marketing lists without opt-in consent.

21.3.14 General

The Promoter may disqualify entries that are late, incomplete, illegible, bulk or automated, or otherwise in breach of these terms; may cancel or amend the promotion where necessary due to circumstances beyond its control (without unfair disadvantage to entrants); and accepts no liability for entries lost, damaged or delayed in transit. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law. These terms are governed by English law and the courts of England & Wales have exclusive jurisdiction.

SECTION 22 – UNAUTHORIZED DATA EXTRACTION
You may not scrape, extract, harvest, or use automated means to collect data from our website without prior written permission from Sparkwood Collectables. This includes but is not limited to product listings, pricing information, stock levels, images, descriptions, metadata, or any other content or data made available through our website. Any such activity is strictly prohibited and may result in immediate termination of your access to our Services, as well as legal action where applicable.
